Adjudicating Moral Damages in Greece from an Economic Analysis of Law Perspective

Senior Associate Charalampos (Harry) Karampelis, who is a regular contributor and author for some of the leading industry publications, recently authored a book which focuses on the legal matter of the adjudication of moral damages in Greece, a legal matter which concerns almost daily the Greek Courts, and was published by Nomiki Vivliothiki.
The current publication concentrates on the legal matter of the adjudication of moral damages in Greece, a matter which concerns almost daily the Greek Courts, especially when taking into consideration the fact that about 80% of the actions filed before the Greek Civil Courts include a request of moral damages allegedly suffered by the claimant(s), as well as the most recent developments in Greek jurisprudence according to which the Supreme Court has the right to examine the reasonableness of the amounts of moral damages adjudicated by the lower Courts of substance according to the proportionality principle.
Delivering actual justice Vs Legal certainty: The monetary satisfaction of moral damages constitute a field of continuous confrontation between the request for the provision of fair solutions that would respond to the circumstances of each individual case on one hand and the necessity to establish certain criteria for the determination of the exact amount and calculation of moral damages which would certainly serve the needs of the legal community for legal certainty.
The book aims at facilitating the legal practitioners towards two directions. On one hand, it makes analytical reference to the up to day approach of the matter under question from theory and jurisprudence.
On the other hand, it proceeds to presenting the methods of the Economic Analysis of Law which could end up to being an extremely useful tool for both lawyers and Judges, when assessing and calculating moral damages, taking into consideration the circumstances of each case.
